Good rules should be clear, accessible and fair.

§ 1. General provisions

These Terms govern the provision by electronic means of services available on the websites operated by MIVARE GROUP PROSTA SPÓŁKA AKCYJNA, with its registered office in Krasnobród (22-440 Krasnobród), entered in the Register of Entrepreneurs of the National Court Register by Sąd Rejonowy Lublin-Wschód w Lublinie z siedzibą w Świdniku, VI Wydział Gospodarczy KRS, under KRS number 0001268091, NIP 9223092251, REGON 545767254, share capital PLN 1,000, e-mail hello@mivaregroup.com, hereinafter the “Service Provider”.

Mivare Group, Mivare Interiors, Mivare Motors, Mivare Systems and Mivare Labs are trading brands of the Service Provider. A brand name alone does not create a separate legal entity.

These Terms apply only to electronic services connected with use of the website. They do not replace general terms of cooperation, a contract, an order, a statement of work or the terms of a specific service.

§ 2. Definitions

• Website — any domain or subdomain operated by the Service Provider and covered by these Terms;
• User — a person using the Website;
• Consumer — a person having consumer status within the meaning of the Polish Civil Code;
• Entrepreneur enjoying consumer rights — a natural person entering into a contract directly connected with their business activity, where the contract is not of a professional nature for that person;
• Electronic Service — a function provided without the simultaneous presence of the parties, through an ICT system, at the individual request of the User.

§ 3. Types and scope of electronic services

• making content and information available;
• a contact form and message submission;
• making documents available for download.

Electronic services are free of charge. Browsing the site, downloading a document or sending an enquiry does not result in the conclusion of a contract for paid Interiors, Motors, Systems or Labs services. Information on the site is presentational and, unless expressly stated otherwise, does not constitute an offer within the meaning of the Polish Civil Code.

§ 4. Technical requirements

• a device with Internet access;
• a current, supported web browser with cookies enabled to the extent necessary for the form and document downloads;
• for the form — an active e-mail address;
• for documents — software capable of opening PDF files.

§ 5. Specific risks

Use of the Internet involves risks of malware, phishing, compromise of a device, unauthorised interception of data or impersonation. The Service Provider applies appropriate safeguards, including an encrypted connection. The User should use current software, verify the domain address and connection certificate, and not disclose passwords or codes to third parties.

§ 6. Cookies

The Website uses only cookies necessary for the operation of the contact form and document downloads. The Website does not install software on the User's device. Details are described in the Cookie Policy.

§ 7. Rules of use

The User uses the Website in accordance with law, these Terms and good practice. It is prohibited to provide unlawful content, in particular:

• attempts to gain unauthorised access, circumvent safeguards or obtain other persons' data;
• scanning or testing vulnerabilities without prior authorisation;
• transmitting malware or automated requests that overload the infrastructure;
• impersonating another person;
• infringing intellectual property rights and the rights of third parties.

§ 8. Conclusion and termination of an electronic-service contract

A contract for browsing content is concluded when a page is opened and terminates when the page is left. A contract concerning the form is concluded when the User begins using the form and is performed when the message is delivered to the Service Provider. The User may stop using the service at any time by leaving the Website.

§ 9. Contact form

The User provides information that is truthful and appropriate to the purpose of the contact. Special-category data, passwords, access keys, payment-card data or identity documents should not be submitted.

§ 10. Intellectual property rights

Texts, photographs, graphics, logos, brand marks, page layouts, code and downloadable documents are protected by copyright or industrial property rights. These Terms do not transfer any rights to the User beyond permitted use. Copying, publishing, modifying or commercially exploiting the materials requires the consent of the rights holder.

§ 11. Links to external websites

The Website may link to third-party resources. Placing a link does not make the Service Provider the operator of those resources or a party to services provided by their owners.

§ 12. Availability of the Website

The Service Provider may carry out maintenance, updates and security activities. It does not guarantee uninterrupted availability of the free Website unless a separate paid contract or SLA provides otherwise. We remedy errors within a reasonable time appropriate to their nature.

§ 13. Liability towards entrepreneurs

In relations with a User who is an entrepreneur, to the extent permitted by law and solely in relation to free use of the Website, the Service Provider is not liable for lost profits or business decisions made solely on the basis of general informational materials. This limitation does not apply to damage caused intentionally. Liability for paid services is governed by the relevant contracts.

§ 14. Consumers

The provisions of these Terms are not to be interpreted as excluding or limiting the statutory rights of a Consumer or an entrepreneur enjoying consumer rights.

§ 15. Complaints concerning electronic services

Complaints concerning the operation of the Website may be submitted to hello@mivaregroup.com or in writing to the Service Provider's registered office address disclosed in the National Court Register (KRS). Where possible, the complaint should contain a description of the issue, the date, the page address and data enabling a response to be provided.

We respond to a complaint within 14 days of its receipt, on paper or another durable medium, in particular by e-mail.

§ 16. Out-of-court dispute resolution

A Consumer may seek assistance from a municipal or district consumer ombudsman, the Trade Inspection authority and competent bodies authorised to conduct out-of-court consumer dispute resolution. Information on these options is published by the Office of Competition and Consumer Protection (UOKiK).

§ 17. Privacy

The rules for processing personal data are set out in the Privacy Policy, and the rules for the use of cookies in the Cookie Policy.

§ 18. Amendments to the Terms

These Terms may be amended due to changes in law, security considerations, changes to the Website's functions or changes to the Service Provider's details. An amendment does not infringe acquired rights and does not operate retroactively to the detriment of a Consumer.

§ 19. Governing law

These Terms are governed by Polish law. The choice of law does not deprive a Consumer of the protection afforded by the mandatory provisions of the country of their habitual residence. Disputes with entrepreneurs concerning the free services of the Website are resolved by the court competent for the Service Provider's registered office.

§ 20. Availability of the Terms

These Terms are made available free of charge on the Website in a manner enabling them to be obtained, reproduced and stored.
